![]() ![]() The EPA released a statement saying the agency was pleased the court had upheld the EPA’s technical and legal basis for identifying areas that need to take additional steps to meet air quality standards to protect public health. Those two counties sued to challenge the decision because both continuously meet fine-particle pollution standards, and officials felt the counties should not be guilty by association because of commuters driving into the Salt Lake Valley. Tooele and Box Elder counties were included as part of the nonattainment area because of the large number of commuters driving in to Salt Lake from eastern Tooele County and southeastern Box Elder County. Court of Appeals in Washington, D.C., was in response to a challenge by local government leaders in Tooele County, Box Elder County and officials from ATK Space Systems, a company in Box Elder County, to not include those two counties as nonattainment areas. ![]() The Environmental Protection Agency’s 2009 decision to include part of Tooele County as a nonattainment area for fine-particle air pollution was upheld Friday after a federal appeals court rejected a lawsuit filed by local officials. ![]()
